MyKey Platform Terms of Use
Chapter 1 Introduction
(Purpose)
Article 1.
The purpose of this Terms of Use is to stipulate the conditions of use, etc. that require the consent of users when using "this system" operated by Digital Agency.
(Definitions)
Article 2.
- The terms used in these Terms of Use shall be defined as follows:
- "The System" refers to a common information platform operated and provided by Digital Agency as "My Key Platform" to utilize the Public Personal Authentication portion of My Number Card's My Key portion (the free space of IC chips and the Public Personal Authentication portion).
- "System User" refers to a person who uses the system.
- "Individual Users" refers to individuals who use the system as the holder of the My Number Card among the users of the system.
- "Business Operators / Users" refers to, among the users of the system, business operators (including sole proprietors, corporations, and voluntary organizations) that use or link the function of customer IDs in their businesses, and business operators that connect to the MyKey Platform and provide services for their businesses.
- "Users of Administrative Organs, etc." refers to Administrative Organs, etc. (as prescribed in Article 3, Item 2 of the Act on the Advancement of Government Administration Processes That Use Information and Communications Technology (Act No. 151 of 2002)) among the users of the System who use or link the functions of Service IDs or PPIDs in the services or businesses they provide.
- "My Number Card" refers to an individual number card prescribed in Article 2, Paragraph 7 of the Act on the Use of Numbers to Identify a Specific Individual in Administrative Procedures (Act No. 27 of 2013).
- "My Key IDs" refer to, among the My Key portion of My Number Card, IDs that are voluntarily created by system users in accordance with Japanese Public Key Infrastructure and whose uniqueness is ensured, and which are registered in the system.
- "Customer ID" refers to an ID given to identify the user of a specific service or business when the user of an administrative organ, etc. or the user of a business conducts the service or business.
- "J-LIS" refers to a Japanese Public Key Infrastructure that is a corporation jointly operated by the national and local governments and is an organization that performs administrative work such as the operation of Basic Resident Register Network System and the provision of Japan Agency for Local Authority Information Systems.
- "electronic certification for user identification" refers to a My Number Card that is stored in a electronic certification's IC chip and certifies that a person who uses a specific service, etc., is the person who requested the use of the service.
- "Signature electronic certification" refers to a My Number Card that certifies that an electronic document created or sent via the Internet, etc. is created and sent by the person who is entered or recorded as the person in charge of creating the electronic document. The signature electronic certification is stored in the IC chips of signatures.
- "PPID" refers to IDs issued by the System that ensure the uniqueness of each administrative service or customer IDs granted in such administrative services, and that enable authentication by My Number Card by linking to customer IDs granted in administrative services.
- "Service IDs" refer to customer IDs that are linked to My Key IDs registered in the system to enable authentication by My Number Card.
- "PPID Usage Service" refers to administrative services for which a PPID is issued and registered in the System.
- "Various IDs" is a generic term for My Key ID, Service ID, and PPID.
(Creation of Various IDs)
Article 3
- Users of the system may agree to comply with these Terms of Use and apply for the creation of various IDs provided by the system or the registration of various IDs in the system by a method specified by Digital Agency for each of various IDs. In addition to the provisions of these Terms of Use, Digital Agency may determine the qualifications of persons who may be issued or registered for each of various IDs.
- Digital Agency shall issue or register the requested IDs only in cases where the creation or registration of various IDs by the users of the system is permitted. In addition, notification of the creation or registration completion of various IDs shall be made by a method separately specified by Digital Agency according to the nature of each.
- Digital Agency may refuse to create or register various IDs in the following cases. Digital Agency is not obliged to disclose the reasons except for cases based on laws and ordinances, etc.
- When all or part of the information provided at the time of application is false, erroneous, or lacking.
- Any other cases in which Digital Agency deems the preparation or registration to be inappropriate.
(Responsibilities of System Users)
Article 4
- Users of this system shall use this system on their own responsibility, and manage the services provided by this system, information related to it, various IDs, and identification numbers linked to various IDs (hereinafter referred to as "ID, etc.") with the care of a prudent manager so as not to be known to third parties without reasonable grounds.
- If ID, etc. is used in this system, it shall be deemed to be used by the person who is obligated to manage it.
(Facilities, etc. of System Users)
Article 5.
- The environmental conditions for the use of the system by the system users shall be the conditions that Digital Agency will post for each of the various IDs.
- Users of the system shall, under their own management, prepare all equipment (including all items related to software and communication means; the same shall apply hereinafter in this Article) necessary to use the various IDs issued or registered in the system at their own expense. In addition, procedures necessary for the preparation of equipment shall be carried out by users of the system at their own risk.
- Users of the system are responsible for all communication costs and other expenses related to the use of the system.
(Digital Agency's Responsibility)
Article 6
- Digital Agency provides this system in accordance with this Terms of Use and the specifications of the system published on the website it manages.
- Unless otherwise indicated, even if the system users are bound or restricted by the terms of use, conditions, specifications, agreements, etc. established by third parties outside Digital Agency (including other ministries and local governments), Digital Agency will not be concerned with such circumstances, and the system users shall deal with such binding and restrictions at their own responsibility and expense, and use the system so as not to violate them.
(Intellectual Property Rights for the System)
Article 7
- All intellectual property rights related to this system (referred to as "intellectual property rights" stipulated in Article 2, Paragraph 2 of the Intellectual Property Basic Act (Act No. 122 of 2002)) belong to Digital Agency or the legitimate right holder who licenses the use to Digital Agency (hereinafter referred to as "Digital Agency, etc." in this article), and are not transferred or attributed to the users of this system.
- When using the system, the system users shall handle programs, works and other intellectual properties related to the system as follows. However, this does not apply when approved by Digital Agency.
- Use only for the purpose of using the System in accordance with these Terms of Use.
- You shall not copy, modify, edit, distribute, etc., nor reverse engineer.
- It shall not be lent or transferred to a third party, or collateral shall not be created, regardless of whether or not it is for profit.
- Not to remove or alter the notice of copyrights or the notice of trademarks displayed by the Digital Agency, etc.; and
(Prohibitions)
Article 8.
- When using the system, users are prohibited from engaging in any of the following activities.
- Acts against the laws and ordinances, public order and morals, etc.
- Unauthorized access to or attempts to access the System and its servers, networks and other systems;
- Acts of using the system by pretending to be a third party other than the user (including acts of stealing or defrauding the right of a third party to obtain points)
- Acts that infringe on copyrights, trademarks and other intellectual property rights contained in the system
- Acts of damaging the credibility of the System or interfering with the operation of the System by spreading rumors or using fraudulent means or force
- Destroying or interfering with the functions of the System's server or network, or any other act that has a negative effect on the System
- Acts of analyzing the system, software, protocol, etc. related to the System by reverse engineering, etc., or acts of falsification, duplication, or secondary use
- Acts that interfere or may interfere with the operation of the system
- Digital Agency may suspend the use of the system without prior notice if the system users engage in acts that fall under any of the items of the preceding paragraph or if it is recognized that they may engage in such acts.
(Available Hours and Suspension of Use)
Article 9
- As a general rule, the system will be available for use 24 hours a day, 365 days a year. However, Digital Agency is only obligated to make efforts to use the system during the available time, and does not guarantee that the system will be usable.
- Regardless of the provisions of the preceding paragraph, the system may not be used due to server operation conditions, concentration of usage, etc.
- Digital Agency may suspend the use of the System for System Users by posting it on the System in advance if it is deemed to fall under any of the following items. However, in cases of urgency, the use of the System may be suspended without posting it.
- When maintenance of the Systems is scheduled
- In the event of a natural disaster, accident or other emergency, or in the event of a serious failure of the System
- In addition to the matters listed in the preceding two items, when it is deemed necessary to suspend the use of the System by Digital Agency
(Termination of the System)
Article 10
Digital Agency may terminate the operation of the System by making an announcement or notification to the Users of the System at least three (3) months prior to the termination date. However, prior announcement or notification shall not be required in the case of emergencies.
(Damages, etc.)
Article 11
- Digital Agency shall not be liable for any damages incurred by the users of the system in connection with the system or the Terms of Use unless such damages are caused intentionally or by gross negligence on the part of Digital Agency. However, if the legal relationship between Digital Agency and the users falls under the category of consumer contract under the Consumer Contract Act, Digital Agency shall be liable for any damages incurred by the users due to's negligence (excluding gross negligence), limited to damages within the scope of normal and direct damages actually incurred by the users. - Notwithstanding the preceding paragraph, Administrative Organ Users and Business Users shall not be held responsible by Digital Agency unless such infringement is caused intentionally or by gross negligence on the part of Digital Agency.
(Revision of Terms of Use)
Article 12
- Digital Agency may revise the Terms of Use if such revision conforms to the general interests of the users of the system, or is reasonable in light of the necessity of the revision, the appropriateness of the contents after the revision, or other circumstances pertaining to the revision.
- When Digital Agency intends to revise these Terms of Use, it shall announce on this system or the Digital Agency website that these Terms of Use will be changed, the contents of these Terms of Use after the change, and when they will become effective, by seven days prior to the effective date of the revision, except for urgent cases.
- If this system user uses this system after the revision of this Terms of Use, this system user is deemed to have agreed to the revised Terms of Use.
(Governing Law)
Article 13
These Terms of Use shall be governed by the laws of Japan.
(Other Necessary Matters)
Article 14.
In addition to the matters stipulated in these Terms of Use, other necessary matters concerning the use of this system shall be stipulated separately by Digital Agency.
Chapter 2 Creation, Management, etc. of My Key ID
(Creation of My Key ID, etc.)
Article 15.
- Individual Users may apply for the creation of My Key IDs and registration in the System using methods prescribed separately by Digital Agency. However, multiple My Key IDs may not be created at the same time.
- Individual Users who have created My Key IDs and registered them in the System may, at their own discretion, revoke their My Key IDs in accordance with the method separately prescribed by Digital Agency.
3. If the My Key ID expires (not limited to the case of the preceding paragraph), the Individual User will be unable to use any of the functions of the system that use the My Key ID (including functions used through Administrative Organ Users).
(Matters to be agreed upon in the creation, etc. of My Key ID)
Article 16
- An individual user agrees to the matters set forth in each of the following items when creating, registering, and using his / her My Key ID (including cases in which the My Key ID is used in association with a service ID; the same shall apply hereinafter in this article).
- In order to confirm the validity of electronic certification for user identification, Digital Agency shall transmit to J-LIS the issue number of electronic certification for user identification of Individual Users (meaning the matters stated in electronic certification for user identification in accordance with Article 26 of the Act on Japan Agency for Local Authority Information Systems's Authentication Services pertaining to Electronic Signatures, etc. (Act No. 153 of 2002); the same shall apply hereinafter).
- In case that Individual Users have updated their My Number Card, in order for such Individual Users to be able to use their accounts for the System created prior to such update, Digital Agency shall be able to use the issue number (hereinafter referred to as "Old Issue Number (s)") of electronic certification for Users' Identification that was issued prior to issuance of electronic certification for Users' Identification used for Individual Users' login to the System.
- The J-LIS shall use the issue number of the electronic certification for identification transmitted under Item (I) to search for the previous issue number and, if any, transmit the previous issue number to Digital Agency in order to enable the processing set forth in the preceding Item.
Chapter 3 Registration, Management, etc. of Service ID
(Registration of Service ID)
Article 17.
- Users of Administrative Organs, etc. may apply for registration in the System of customer IDs of services or businesses managed by them that conform to specifications, etc. separately determined by Digital Agency as service IDs linked to My Key IDs issued to Individual Users.
- When receiving the submission of My Key ID from an individual user, the user of an administrative organ, etc. shall obtain the consent of the following matters.
- The customer ID of a specific service or business and the My Key ID shall be linked and registered as a service ID in the System.
- In order to check whether or not an Individual User has changed his or her address, etc., Digital Agency shall transmit the issue number of his or her electronic certification for user identification to J-LIS, shall confirm the validity of the electronic certification for signature associated with the issue number of the electronic certification for user identification, and shall share the confirmation results with the users of Administrative Organs, etc.
- Users of Administrative Organs, etc. shall respond to inquiries and disputes from Individual Users relating to Customer IDs and Service IDs and shall not make direct inquiries, etc. to Digital Agency or J-LIS regarding the management and use of Service IDs.
(Responsibility to Individual Users)
Article 18.
- Responses to inquiries and disputes from individual users related to service IDs (excluding matters related to My Key IDs) shall be carried out at the expense and responsibility of users of administrative organs, etc.
- Digital Agency has no knowledge of the terms of use established by the users of administrative organs, etc. for the relevant services or businesses, contracts with individual users, or other agreed matters, and the users of administrative organs, etc. are responsible for their own expenses and communication with individual users (including response to the occurrence of disputes and compensation for damages).
Chapter 4 Creation and Management of PPID
(Creation of PPID, etc.)
Article 19
Users of Administrative Organs, etc. may create a PPID for services they manage that conform to the specifications separately stipulated by Digital Agency and apply for registration in the System.
(Matters to be Agreed for Each Used Function)
Article 20.
- When a user of a service managed by the user of an administrative organ, etc. uses the system through the service using PPID, the user shall obtain consent from the user regarding the matters listed in the following items.
- The electronic certification for user identification shall be transmitted to the System provided by Digital Agency through the system for services using PPID.
- In the Digital Agency, the PPID shall be managed in association with the issue number of the electronic certification for user identification of the users of the services using the PPID.
- In some cases, users of Administrative Organs, etc. may manage PPIDs by linking them with customer IDs and other identification numbers assigned to users of services using PPIDs.
- In order to confirm the validity of electronic certification for user identification of users of services using PPID, Digital Agency shall transmit the issuance numbers of electronic certification for user identification of such users to J-LIS.
- In case that Users of Services for Use of PPIDs have updated their My Number Card, etc., Digital Agency shall be able to use their old issue numbers in a manner such that such Users will be able to use the System accounts created prior to such updates.
- The J-LIS shall search for the old issue No. using the issue No. of the transmitted electronic certification for identification of users and, if any, transmit the old issue No. to Digital Agency in order to enable the processes specified in the preceding Item.
- When users of the services managed by the Users of Administrative Organs, etc. use the electronic certification for user identification in My Number Card through the PPID Use Service without entering the PIN number for the electronic certification for user identification, they shall obtain the consent of the users regarding the matters set forth in the following items.
- My Number Card shall receive from users of services using PPIDs, via the system, information about their birth dates read from Digital Agency using the AP for Assisting Entry of Information Items on Face Sheets or information about their birth dates held by users of administrative organs, etc. managing services using PPIDs.
- The name, address, date of birth, and sex read from the My Number Card using the supplementary AP for inputting information on face sheets shall be transmitted to the system for services using PPIDs managed by users of administrative organs, etc.
(Responsibilities to Users of PPID Services)
Article 21
- Responses to inquiries from users of services using PPID and to disputes shall be made at the expense and responsibility of users of administrative organs, etc.
- Digital Agency is not involved in the terms of use established by the users of administrative organs, etc. for the PPID use service, contracts with the users, and other agreed matters, and the users of administrative organs, etc. are responsible for communication with the users (including response at the time of conflict occurrence and compensation for damages).
Chapter 5: Matters concerning Individual Number Card Point
(Definition of Terms Related to Individual Number Card Point)
Article 22
- The terms used in this chapter are defined as follows.
- "Individual Number Card Point" refers to points, etc. that can be used in the target cashless payment service that the target payment business operator grants to the specified target person under the specified requirements.
- "Individual Number Card Point projects" refer to projects that aim to use Individual Number Card Point to revitalize consumption, improve the quality of life, promote the spread of My Number Card, and build a public and private cashless payment platform.
- "Individual Number Card Point Secretariat" refers to the corporation that operates this project designated by Ministry of Internal Affairs and Communications, which has jurisdiction over the Individual Number Card Point project (Environmental Co-Creation Initiative Secretariat or Cashless Promotion Council).
- "Cashless payment services" refer to electronic payment services that can be used repeatedly for general purchases, such as electronic money, QR code payment, and credit cards.
- "Registered settlement business operator" refers to a business operator that provides cashless settlement services and has been registered with the Individual Number Card Point Secretariat in relation to Individual Number Card Point services.
- "Target Cashless Settlement Service" refers to a cashless settlement service provided by a registered settlement business operator and selected by the system users who wish to link their My Key IDs when applying for Individual Number Card Point.
- The term "Target Payment Service Providers" refers to business operators that provide target cashless payment services.
- The term "Settlement Service IDs" refers to IDs such as numbers recognized by users of cashless settlement services that are designated by registered settlement business operators to accept Individual Number Card Point applications.
- "User IDs at the time of settlement" refer to IDs such as numbers that the registered settlement business operator who received an application for Individual Number Card Point can notify to the system to identify the subject.
- "Application support business operators" are business operators that are entrusted by the Individual Number Card Point secretariat for Individual Number Card Point projects and support the application procedures for Individual Number Card Point.
- "Mynaportal" refers to a system operated by Digital Agency to provide services such as online application of administrative procedures and information acquisition (a generic term for websites provided by https://myna.go.jp and its sub-domains and Mynaportal apps).
- "public money receiving account" refers to a deposit account provided by Digital Agency that can be used for the payment and receipt of money related to the payment of public benefits by the head of an administrative organ, etc., in accordance with the Act on Registration, etc. of Deposit Accounts for the Prompt and Reliable Implementation of Public Benefits, etc. (Act No. 38 of 2021).
(Matters to which System Users agree when applying for Individual Number Card Point)
Article 23.
- When individual users apply for Individual Number Card Point, they shall be deemed to have agreed to the matters listed in the following items.
- To provide the settlement service ID of the individual user to the subject settlement business operator.
- The system receives the validity confirmation result of the payment service ID of the individual user in the target cashless payment service and the user ID at the time of settlement transmitted from the target payment provider.
- User IDs of personal users at the time of settlement and application information for Individual Number Card Point shall be provided to covered settlement business operators.
(Matters agreed upon by system users when applying for Individual Number Card Point related to applications to use My Number Card as a health insurance card)
Article 24
When Individual Users apply for Individual Number Card Point related to applications to use My Number Card as a health insurance card, they shall be deemed to have agreed to provide Mynaportal with the issuance number of electronic certification for user identification of Individual Users.
(Matters to which the System Users agree when applying for Individual Number Card Point pertaining to public money receiving account registration)
Article 25.
- When individual users apply for Individual Number Card Point related to public money receiving account registration, they shall be deemed to have agreed to the matters set forth in the following items.
- To provide the public money receiving account registration and management system with the issue number and old issue number of the electronic certification for user identification.
- This system receives the registered status of the public money receiving account transmitted from the system that registers and manages the public money receiving account.
(Connection to the System for Individual Number Card Point Services)
Article 26
- Businesses approved by Digital Agency Users can connect to the system under the provisions of the following items for data linkage between the system and external systems operated by businesses.
- Registered settlement service providers may connect to the System within the scope necessary for the execution of their Individual Number Card Point services.
- Among application support providers, those who support Individual Number Card Point application procedures through ATMs or multi-copy machines can connect to the system within the scope necessary for the execution of Individual Number Card Point services.
(Loss of Rights)
Article 27.
- Digital Agency shall forfeit the right to apply for Individual Number Card Point in any of the following cases:
- If the My Key ID has been revoked by a user of the system
- If the user of this system violates this agreement
- Upon completion of the operation of the System
